The DA is charging him with murder because he murdered someone.The possibility exists that the DA is charging him with 1st degree murder BECAUSE he knows he'll never get a conviction. The DA is seen doing his job and charging someone who committed a crime, and he doesn't have to worry that it will lead to putting a man in jail who doesn't need to be there.

More evidence in this case, such as eye witnesses.
